Welcome to Shrasti Physio Devices. These Terms & Conditions (“Terms”) govern your access to and use of the website www.shrastiphysiodevices.com (the “Site”) and the purchase of products from us. By using or placing an order via the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
- “Company,” “we,” “us,” or “our” refers to Shrasti Physio Devices.
- “You,” “your,” or “User” refers to any visitor, customer, or person accessing or using the Site.
- “Products” means the physiotherapy, rehabilitation, medical, wellness, or allied equipment and accessories offered for sale on the Site.
- “Order” means your request to purchase one or more Products via the Site.
- “Agreement” refers to these Terms & Conditions, including any referenced policies (e.g. Privacy Policy, Return Policy).
Eligibility: By using this Site, you affirm that you are at least 18 years old or have the legal capacity to enter into binding contracts.
Agreement to Terms: These Terms apply to all visits to the Site, whether as a guest or registered user, and every Order placed.
Modifications: We reserve the right to update, change or replace any part of these Terms at any time. Changes will be effective when posted on the Site, and your continued use constitutes acceptance of those changes.
User Account: To place an Order, you may need to register an account, providing accurate, current, and complete information.
Credentials: You are responsible for maintaining the confidentiality of your account login and password and for all activity under your account.
Unauthorized Use: You must immediately inform us if you become aware of any unauthorized access to or use of your account.
Descriptions: We aim to describe Products accurately, but we do not warrant that descriptions, colors, images, or specifications are completely accurate or error-free.
Prices: All prices shown are in Indian Rupees and are inclusive of applicable taxes unless otherwise stated. We reserve the right to correct pricing errors or omissions.
Promotions: Discounts, coupons, or special offers may have conditions and expiry dates. We may revoke or restrict promotions at our discretion.
Order Process: Once you place an Order and payment is confirmed, we will send an acknowledgment email. This does not constitute acceptance—your Order is accepted when we dispatch the Product or confirm availability.
Payment Methods: We accept payment via authorized credit/debit cards, net banking, UPI, or other methods displayed on the Site. All payments must be cleared before fulfillment.
Taxes & Charges: You are responsible for any applicable taxes, duties, or import charges on Orders delivered outside your home state or overseas.
Shipping: We will arrange shipping/delivery via courier or freight partners. Shipping timelines and costs will be provided at checkout or as separately communicated.
Risk & Title: Risk of loss or damage passes to you once Products are delivered to the carrier. Title (legal ownership) passes to you only once full payment is received.
Acceptance & Inspection: Please inspect shipments immediately. If there is damage or discrepancy, you must notify us within [X days, e.g. 7 days] of delivery (see our Return / Dispute policy).
Return Eligibility: Returns may be allowed under certain conditions (defects, damage, nonconformity). Products must be unused, in original packaging, and with all parts.
Return Process: To initiate a return, contact our support with order details and photographs. We will provide a return authorization and address.
Refunds: Once we receive and inspect the returned Product, we will process a refund (minus shipping) within [X] days.
Warranty: Many Products come with manufacturer’s warranty. The warranty covers defects in materials or workmanship under normal use. It does not cover damage from misuse, alteration, or improper installation.
Claim Procedure: For warranty claims, you must provide proof of purchase and detailed description of the defect. We or the manufacturer may require evaluation or repair.
You agree not to:
Use the Site in a manner that violates laws or regulations;
Post or transmit harmful or unlawful content (e.g. fraud, harassment);
Interfere with the Site’s operations or security;
Use automated means (bots, scrapers) to fetch data from the Site;
Impersonate others or misrepresent your affiliation;
Use Products for illegal or negligent purposes.
All content on the Site — text, graphics, logos, images, software — is the property of Shrasti Physio Devices or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content without our prior written permission.
No Warranty: The Site and Products are provided “as is” without warranty of any kind. We disclaim all express or implied warranties, including fitness for a particular purpose or non-infringement.
Limitation of Liability: To the fullest extent allowed by law, we (and our affiliates, employees, agents) shall not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the Site or Product use.
Cap on Liability: Our total aggregate liability under or relating to these Terms shall not exceed the amount you paid for the Product giving rise to the claim.
You agree to indemnify, defend, and hold us (and our officers, directors, employees, agents) harmless from and against any and all claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of (a) your violation of these Terms, (b) your misuse of the Site or Products, or (c) your breach of any representation or warranty.
Your use of the Site is also governed by our Privacy Policy, which outlines how we collect, use, store, and protect your personal information. By accepting these Terms, you also consent to the practices described in the Privacy Policy.
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision shall be severed or limited to the minimum scope necessary, and the remaining provisions shall continue in full force. Our failure or delay in enforcing rights under these Terms does not constitute a waiver of those rights.
We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, strikes, pandemics, governmental actions, or supply chain disruptions.
Governing Law: These Terms and any disputes arising herefrom will be governed by and construed in accordance with the laws of India, particularly the laws of the State in which our principal office is located.
Dispute Resolution: Any dispute or claim shall first be attempted to be resolved amicably through negotiation or mediation. If unresolved, it shall be subject to the exclusive jurisdiction of courts in Delhi, India (or your city, as applicable).
